Public Offer Agreement for the Provision of Services

1. General Provisions

This Agreement (hereinafter referred to as the Offer) is an official proposal by OXUS CAPITAL GROUP LLC (hereinafter referred to as the Company/Service Provider), published on the website https://ustabor.uz/, for the provision of services to individuals and legal entities (hereinafter referred to as Users) using the website tools in accordance with the terms set out below.

Acceptance of the terms of this Offer means that the User is fully and unconditionally ready to comply with all terms of the Agreement without any exceptions or restrictions.

Terms and Definitions

The following terms are used in this Agreement:

• Offer — a public Agreement setting out the terms of service provision by the Service Provider and the rules for using the Website services.
• Acceptance — the User's acceptance of all terms of this Agreement, including all its addenda, and readiness to fulfill them.
• Service Provider — OXUS CAPITAL GROUP Limited Liability Company.
• Website — https://ustabor.uz/ — a web resource owned by the Service Provider, serving as a communication platform for posting classified ads by category.
• User — an individual or legal entity that has accepted the terms of this Offer to use the Website services.
• Product — any object of material or non-material value.
• Service — any action not related to product delivery that relates directly to the Website service.
• uz Service — all paid and free services provided by the Company on the Website (features, content, data, images, information, software, etc.).
• Account — an electronic personal cabinet created by the User for subsequent management of ads.
• Registration — the procedure established by the Service Provider to obtain access to the Website functionality. Considered complete after successfully passing all steps, including SMS verification.
• Personal Data — accurate and current information about the User requested for identification of an individual.
• SMS Verification — confirmation of a phone number via an SMS code.

If the User is not ready to comply with the terms of the Offer, the Service Provider strongly recommends leaving the Website. After completing Registration or starting to use services, the User confirms readiness to fully comply with all terms of the Offer.

The Service Provider enables the use of the resource to post information about products/services for subsequent purchase/sale transactions between Users. Transactions are concluded directly, without the participation of the Service Provider. The Company acts as a communication platform, not as an intermediary.

2. Terms for Posting Ads

To access ad posting, the User must fill out a special form and specify the characteristics of the advertised products/services.

The User gains access to additional Website features after completing registration and verifying the specified phone number.

Use of the Website functions obligates both authorized and unauthorized users to follow the Ustabor.uz user policy rules.

The User is responsible for all operations performed using the specified phone number and password. The password is confidential information and must be kept secret.

Posted ads must comply with the terms of this Offer and contain an accurate and complete description of products/services. By posting an ad, the User guarantees that operations with the product/service are carried out on a legal basis.

The User undertakes to post only accurate information. If it does not correspond to reality — make corrections or deactivate the ad and create a new one.

List of Restrictions

It is prohibited to:

• Post the same ad twice in one profile.
• Post ads with similar content about the same object.
• Post the same ad from different phone numbers.
• Post ads in inappropriate sections.
• Post ads with titles containing repeated or non-letter characters.
• Post ads with unreadable or unrelated descriptions, titles, or images.
• Offer several products/services in one ad.
• Post links to potentially harmful resources.
• Post ads for products/services that do not comply with legislation.
• Post ads that do not match the selected geographic location.
• Post personal or intimate photographs, as well as images downloaded from the internet.

Prohibited Product Categories

It is prohibited to advertise the following in ads:

• Alcoholic beverages.
• Cigarettes, tobacco products.
• Narcotic substances.
• Products/services/materials related to pornography.
• Medicines regardless of their purpose.
• Goods in illegal possession.
• Items posing a threat to life and health.
• Non-existent objects.
• Human and animal organs.
• Software for conducting illegal operations.
• Personal documents and securities.
•  
• Weapons, ammunition, and their components.
• Defense equipment.
• Walrus tusks, elephant ivory (except for finished items).
• Precious metals and stones (except for finished items).
• Rare animals not available for legal sale.
• Any other offers that can be considered a violation of the Offer terms or legislation.

Service Provider's Rights Regarding Ads

The Service Provider has the right to:

• Correct punctuation and/or spelling errors in an ad without changing its meaning.
• Change the category of an ad if it better matches the description of the advertised object.
• Refuse to post an ad that does not match the topic of the selected section or contradicts the terms of the Agreement.
• Introduce restrictions on the number of ads posted by one User without explanation.
• Shorten or extend the period of ad display for technical reasons.

The ad title must correspond to its text. It is prohibited to include contact details or links to third-party resources in the title.

Images must correspond to the title and description of the product/service. Posting stock images and images downloaded from the internet is not permitted.

Ads are reviewed by moderators before posting. The decision to remove an ad is final.

3. Grounds for Removing Ads

If an ad contains violations of the terms of this Offer, the Service Provider reserves the right to refuse posting or remove the ad. Grounds for removal:

• Re-posting the same ad while one of them is already active.
• Presence of data contradicting the terms of the Offer or legal requirements.
• Inaccurate information in the ad.
• No information about the product/service in the title.
• Repeated punctuation marks or non-letter characters in the title.
• Links to third-party web resources in the description or image comment.
• Lack of meaningful connection between the image and the product description.
• Images with user interface elements or abstractions.
• Advertising content in images (links, contact details, social media profiles).
• Poor quality images that do not allow evaluation of the product's characteristics.
• Posting an ad in an inappropriate category.

4. Rights and Obligations of the Parties

All objects available when using the Company's services, including design elements, text content, images, video, software tools, etc., are the property of the Service Provider, Users, and other rights holders.

Use of the Website content is available only within the scope of using the platform's services. Content may not be used for other purposes without the official consent of the rights holder.

Posting an ad constitutes the User's full and indefinite consent to manage, post, collect, copy, and present the provided author's data. The right of ownership of the information content remains with the User.

User's Obligations

• Provide personal identification data during registration.
• Not perform operations that cause an unreasonably high load on the resource.
• Not use automated services to access the Website without prior written consent of the Service Provider.
• Not provide information presented on the Website to third parties without the official consent of the Service Provider.
• Not obstruct the operation of the Website and the conduct of automated processes.
• Not use information provided by other Users for personal purposes without their written consent.

The User Has No Right to

• Discuss the actions of the resource administration, except through direct message exchange with the administration.
• Use names similar to those of other Users for the purpose of impersonating them.
• Access the personal information of other Users without their written permission.

Service Provider's Rights and Guarantees

The Service Provider guarantees proper fulfillment of all its obligations under this Offer, including ensuring high quality of service and maintaining the confidentiality of Users' personal information.

The Service Provider reserves the right to impose restrictions on the number of active ads of a User, as well as to change or suspend the operation of some Website functions.

The Service Provider has the right to restrict access to services or delete a User's Account in case of violation of the terms of this Offer.

The Service Provider may ask the User to provide confirmation of information specified during registration. In case of refusal — restrict access to services.

SMS Verification. The Service Provider may at any time carry out a verification procedure by sending a code to the specified number. Only numbers of mobile operators of the Republic of Uzbekistan should be used for verification.

The Service Provider has the right to block an account registered under real estate trading rights if the User has been using the Website services for more than 30 days without purchasing a tariff plan.

To submit complaints, the User may use the feedback form. Applications are reviewed by moderators within two business days.

5. Payment Policy

The purchase of paid services of the Ustabor.uz website may be made from the User's Personal Account or other sections of the resource. The User must study the pricing policy of paid services before purchasing.

Conditions for Compensation of Paid Services

• The cost of a paid ad (top) removed by moderators is automatically compensated by the system, taking into account the days when the service was inactive.
• If the service was not provided for technical reasons, compensation is made by the Website administration after the User provides proof of payment. Funds are credited to the Personal Account wallet.
• Funds directed to pay for ads containing prohibited products/services are not refundable upon profile deletion.
• In case of two or more violations of the Offer terms, compensation is made only after the user's application and its review by the administration.

The Service Provider has the right to refuse a refund if the User has violated the Offer terms two or more times.

Refunds to a bank card are only possible after filling out the feedback form. The User may return funds between the 1st and 25th of the same month in which the account was topped up.

6. Disclaimer of Service Provider's Liability

Using the Website services constitutes the User's automatic agreement that they understand all existing risks and take all responsibility associated with posting ads.

The Service Provider does not participate in transactions. The Website acts solely as a marketplace for interaction between Users.

The Service Provider cannot control the quality and reliability of information in ads and disclaims liability for any damage caused within a transaction.

The Service Provider disclaims liability for illegal access to the Website servers and for viral and system programs transmitted to the Website by third parties.

Users fully assume responsibility for the quality, protection, legality, and compliance of the product with the stated characteristics.

If one User has claims against another, the User undertakes to resolve issues independently without involving the Service Provider.

The Service Provider disclaims liability for non-performance of obligations in force majeure circumstances (legislative requirements, technical failures, natural disasters, etc.).

7. Task Posting and Fulfillment Policy

It is strictly prohibited to post tasks on the Website that relate to:

• Providing loans, credits, and dubious financial operations.
• Redirecting and registering Users on third-party websites.
• Promoting own or third-party products and services.
• Offering intimate services or escort services.
• Pornographic content, intimate online chats.
• Selling jewelry, including production waste containing rare metals and stones.
• Precious metal ingots and any transactions with precious metals, stones, or pearls.
• Offers to assist in military operations.
• Transactions involving weapons, ammunition, explosive materials.
• Chemicals and pesticides with restricted circulation.
• Poisons and toxic substances.
• Museum exhibits and collectibles belonging to the Museum Fund of the Republic of Uzbekistan.
• Promoting gambling, online casinos, lotteries, betting exchanges.
• Any cryptocurrency and financial games (forex, bitcoin, online investments, etc.).
• Distribution of confidential information and personal data.

8. Profile Deletion Rules

The owner of the Ustabor.uz website reserves the right at its own discretion to modify or delete any information violating these Rules, as well as to suspend or terminate the User's access to the Website services.

Deletion of a User's Profile means automatic deletion of all information posted on it. After deleting the profile, the User loses access rights to the Website.

8.1. Profile Deletion by the User

Each user has the right to delete their profile using the following instructions:

1. Log in to your Personal Account.
2. Go to the 'Profile' tab.
3. Click on the 'Delete Profile' tab.
4. In response to the question 'Are you sure you want to permanently delete your account?' click 'OK'.

The Service Provider has the right to independently delete the User's account and page data on the Ustabor.uz website. The Website owner reserves the right to store backup data copied before profile deletion.
